Clear definitions and requirements for licensee identification are set to guide advertising practices within the cannabis industry.

Definitions of Advertising: Outlines what constitutes advertising and differentiates between labels, editorial content, and paid promotions.

Licensee Identification: All advertising and marketing must prominently display the licensee's number, ensuring accountability and traceability.

Marketing Defined: The act of promoting or selling cannabis or cannabis products, with specific mention of sponsorship and product design targeting certain demographics.

Advertising is regulated based on audience composition and the method of communication, with a focus on preventing access and exposure to underage individuals.

Audience Restrictions: Marketing is allowed only where the majority (71.6%) of the audience is reasonably expected to be 21 years or older.

Age Affirmation Methods: Direct communication must include age verification to ensure recipients are of legal consumption age.

Truthful Advertising: All advertisements must be substantiated and truthful, without creating misleading impressions about the products.

The code outlines explicit prohibitions to prevent misleading, attractive-to-minor, and false health-related claims in cannabis advertising.

Misleading Impressions: Ads must not be false or create misleading impressions regarding the brand, origin, or health effects.

Location Restrictions: Prohibits advertising near schools, playgrounds, or youth centers and across California state borders.

Attractiveness to Children: Ads must not contain elements that appeal to children, such as cartoons or toys.

Exceptions to advertising regulations acknowledge noncommercial speech and internal marketing not visible to the public.
