Marketing Your Illinois Dispensary

In Illinois, the advertising landscape for cannabis business establishments is governed by robust regulations designed to ensure ethical marketing practices. Section 410 ILCS 705/55-20 outlines a clear framework aimed at protecting consumers, particularly minors, from misleading or inappropriate cannabis-related advertising. The state's commitment to upholding public health and safety is evident through these stringent rules.

Illinois strictly prohibits any form of advertising by cannabis establishments that could mislead consumers or appeal to those under the age of 21.

Ads must not contain any false or deceptive content.

There should be no promotion of excessive use of cannabis products.

Advertisements must not show individuals consuming cannabis.

No ad may depict or seem to include underage individuals.

Cannabis ads should not make health or therapeutic assertions.

The state has clear mandates on where cannabis advertising should not be placed, taking careful consideration to avoid locations frequented by minors.

Ads must not be within 1,000 feet of schools, playgrounds, childcare centers, and other youth-centric areas.

Cannabis advertising is not allowed on public transportation or public property.

Similar to content prohibitions, ads cannot mislead, promote overconsumption, or appeal to those under 21.

While advertising restrictions are comprehensive, there is an allowance for educational messages regarding cannabis.

Informational messages aimed at educating the public are exempt from typical advertising restrictions.

Promotional activities by cannabis businesses are also under scrutiny to avoid practices that might entice minors or encourage unsafe consumption of cannabis products.

It is not permissible to offer cannabis or cannabis products as part of a sales promotion.

Businesses cannot engage in activities that promote the consumption of cannabis in a game or competition format.

Any promotional materials should not be attractive to children in any manner, including resembling candy packaging or labeling.
